Employment Law & Management for Small and Mid-Sized Healthcare Clinics

As the owner, manager, or HR director of a medical practice or other allied health clinic, cultivating a stable and clinically effective staff with high morale and loyalty to the practice is critical to delivering quality patient care and sustaining growth.

For just a fraction of the cost of one billable hour of a lawyer’s time, you’ll learn critical legal concepts and key practical skills like:

  • How to draft and negotiate key provisions in physician employment agreements and set clear expectations with your medical staff.
  • How to structure physician compensation packages and incorporate bonus incentives, benefits, malpractice coverage, and other perks fairly, compliantly, and effectively.
  • How to approach restrictive covenants like noncompetition, nonsolicitation, confidentiality, and nondisparagement, to enforce them wisely without undermining recruitment or patient care.
  • How to safeguard the valuable intellectual property funded and facilitated by your practice’s investments and resources through work-for-hire provisions, invention assignments, and clinical research contracting.
  • How to apply the six-factor “economic reality” test for classifying staff as W-2 employees or 1099 independent contractors in healthcare settings and avoid misclassifications.
  • How fundamental concepts of federal employment law, including wage and hour rules, ADA disability accommodations, FMLA leave, FCRA background check requirements, workers’ comp rules, OSHA standards, and more, impact smaller healthcare practices.
  • How to navigate employee terminations and separations, including the distinctions between for-cause and no-cause terminations and resignations for “good cause,” issues of patient continuity of care, and handling final pay.
